Your website is collecting (and sharing) personal information Generating leads is essential for just about every website owner. And because your website could be collecting this information from website visitors located anywhere, you may be required by multiple privacy laws to provide a website Privacy Policy that makes specific disclosures required under each law. Thereās nothing wrong with collecting personal information, rather itās a great thing that helps a business grow. Itās just that these days, you need to have a Privacy Policy that contains specific disclosures.
Non-compliance fines and lawsuits are significant⦠and more privacy laws are coming. Throughout 2024, there has been a significant increase in small business website owners receiving demand letters for non-compliance with privacy laws. CIPA, for example, is a California privacy law that can apply to businesses located anywhere, and several law firms are now using this law to sue small business owners for $30,000+ in damages (because the website did not get proper consent from visitors prior to loading third party analytics and/or tracking technologies).
Privacy is becoming more and more important over time. The minimum fine for non-compliance starts at $2,500 per website visitor whose rights youāve infringed upon (imagine getting a non-compliance fine for just 100 site visitors!). On top of that, privacy laws change and new laws go into effect, meaning you need to have a strategy to keep your Privacy Policy up to date over time. Not to mention, I think we all appreciate and deserve a right to privacy. And it turns out having a privacy friendly website can even be a competitive advantage!
